1. General conditions
1.1 These Terms and Conditions of Sale apply to the purchase of goods and services from. www.ialstudio.ee or any of its sub-domains (the “E-shop”). The owner and operator of the E-shop is I.A.L Disainerstuudio OÜ (registration code 16311073), address Linnamäe tee 6, Keila, Harju County, 76605. The person who has made a purchase in the E-shop is hereinafter referred to as the “Customer”.
1.2 In addition to the terms and conditions set out on this page, the relationship between the Customer and the E-shop is governed by the Law of Obligations Act, the Consumer Protection Act and other relevant legislation in force in the Republic of Estonia.
1.3 E-poE reserves the right to unilaterally modify these Terms and Conditions and the terms and conditions of the Products at any time. Such changes will be reflected on the website www.ialstudio.ee/muugitingimused.
1.4 Products sold in the e-shop are subject to copyright protection. The Products are intended for the Customer’s personal use and no reproduction, summary, copying, reference, modification, distribution or making available to third parties of the Products or related materials is permitted. The Customer in breach of the foregoing prohibition shall be liable to pay a single product price for each person to whom the relevant product materials have been made available in whole or in part. The obligation referred to in this clause shall be valid for an indefinite period and shall not expire at the end of the contract of sale of the product.
2. Price information and placing an order
2.1 The description of the Products and the prices are indicated in the Online Shop. The prices of the Products are given in Euro.
2.2 In order to purchase a Product, you must select the relevant product or service (the “Product”) in the E-shop, fill in the information fields required on the website and select the appropriate payment method.
2.3 It is possible to pay in the e-shop by bank transfer, by credit or debit card or by requesting the Montonio hire-purchase option. The payment intermediary in the E-shop is Montonio Finance UAB (registration code 3050205122), address Konstitucijos pr. 7, Vilnius, Lithuania.
2.4 A promotional code can be applied in the e-shop. A promotional code is a unique code that we issue either to all shoppers or to specific shoppers. To use the discount code, you must enter the code in the “Coupon code” field when placing your order and click on the “Apply coupon” button, after which the discount will be applied to the prices in your shopping cart.
2.5 Check the correctness of the data you have entered, the contents of the shopping cart and the amount of the purchase, and click on the “Place order” button to proceed with the purchase.
2.6 Fulfillment of the order will be automatic once the payment has been received and the “Back to Merchant” button is clicked. The order confirmation will be sent to the Customer’s email address entered when placing the order, usually within a few minutes.
3. Digital products
3.1 Certain products, including training courses, Notion templates, masterclasses and e-courses (the “Digital Product”) are only available to the Customer digitally in the E-shop’s online Customer environment, which can be logged into at. www.ialstudio.ee/logisisse (hereinafter referred to as the “User Environment”).
3.2 The Customer who has purchased a Digital Product must have the technical capability to view and listen to video material, open .pdf and Google Drive files in order to view the Materials, including the ability to use a computer or smart device with a reasonably fast internet connection and speakers or headphones. The E-shop shall not be liable for any problems or impediments that the Customer may experience in using the Digital Product’s facilities due to the Customer’s technical equipment or internet connection not being up to standard.
3.3 The Digital Products do not include personalised advice or the answering of further questions via e-mail, social media messages or other channels. They are self-learning informative materials.
3.4 The Customer has the right to use the User Environment and to access the Products indefinitely, i.e. for as long as the E-shop is in operation and offers these Products. In the event of the closure of the E-shop due to the termination of its operations or the discontinuation of the sale of the Product, the Customer shall have the right to access the Digital Products purchased for a period of at least 30 days.
3.5 The E-shop may make changes to the materials contained in its User Environment. The E-shop does not undertake any obligation to update the Materials.
3.6 The Customer understands and accepts that the E-shop cannot guarantee any specific result or time target, as the result will depend to a large extent on the Customer’s expectations, the thoroughness of the review of the Materials, the manner of implementation and consistency.
3.7 E-po has the right to unilaterally restrict the Customer’s access to any Products or the User Environment if there is reasonable suspicion that the Customer has breached any of the terms of the Product Sales Agreement, including these Terms of Sale. This is the case, for example, where the pattern of logging into the User Area and watching videos gives rise to suspicions that access has been shared with third parties.
4. Right of withdrawal
4.1 Due to the conditions listed in § 53(4) of the Law of Obligations Act, the 14-day right of return does not apply to E-shop products.
4.2 A Customer (other than a legal entity) who has purchased a Digital Product has the opportunity to withdraw from the purchase within 14 days, but only if he/she has not begun viewing the materials and this is confirmed by an extract from the User Interface. In order to withdraw from the contract, the E-shop must be informed as soon as possible, but not later than 14 days from the date of the purchase. Notification must be made by e-mail (isabel@ialstudio.ee), clearly stating in the letter your wish to withdraw from the purchase and the e-mail address used to make the purchase.
4.3 The money will be returned to the Client’s current account within 2-10 business days after the payment order is entered.
5. Right of complaint and dispute settlement
5.1 The e-shop is liable for any non-conformities and defects that occur during the consumption of the product. (For example, if, for technical reasons on the part of the E-Store, watching a video or opening a file does not work.) The product is presumed to be in conformity. It is the Customer’s responsibility to rebut this presumption.
5.2 In the event of a defective Product, the Customer has the right to lodge a complaint with the E-shop. In the event of a defect in the Product, the Customer shall immediately cease to use the Product and immediately submit a complaint to the E-shop. The Customer shall submit the complaint by e-mail to the following address isabel@ialstudio.ee and must include the Customer’s name, telephone number, e-mail address (with which the purchase was made), confirmation of the order and a precise description of the non-conformity or defect.
5.3 The E-shop will contact the Customer as soon as possible, but not later than 5 working days from the receipt of the complaint.
5.4 The E-shop is not liable for any defects in the product caused by improper use of the product.
5.5 If the Customer and the E-shop are unable to resolve the dispute by negotiation, the Customer may refer the dispute to the Consumer Disputes Committee. The Consumer Disputes Committee is competent to settle disputes arising out of a contract concluded between the Customer and the E-Store. The examination of the Customer’s complaint by the Commission is free of charge.
